In addition to substantial creditor representation in numerous litigation and bankruptcy matters, Ms. Kirk has represented dozens of commercial and individual debtors in Chapter 7 liquidation and Chapter 11 reorganization proceedings throughout Texas, including hospitals, retail operators, shopping centers, hotels, landlords, franchise owners, land developers, restaurants, and a market and tradeshow center. Ms. Kirk has also represented lenders, mortgage servicers, Chapter 7 Trustees, commercial landlords, and various other creditors with respect to a wide variety of bankruptcy and litigation issues. Ms. Kirk has considerable experience in prosecuting and defending against non-dischargeability actions, preference avoidance actions, fraudulent transfer avoidance actions, protracted lawsuits and appeals for and against mortgage lenders and servicers, fiduciary and foreclosure litigation, and appeals in federal and state court.
